1. Acceptance of terms
By accessing or using Stackbastion (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
Stackbastion is operated by AKTAI LTD (see company details). These terms apply to the account holder, anyone they authorise to use the account, and site visitors.
2. Description of service
Stackbastion is managed hosting and production operations for applications, typically ones built with an AI coding tool, that have outgrown their original hosting platform. Depending on your plan, the Service includes infrastructure provisioning, deploys, TLS certificates, database backups with tested restores, uptime monitoring, and infrastructure incident response. The exact scope per plan is set out on the pricing page.
We run your infrastructure. You own your application.
Stackbastion operates the server, containers, network, database, and backups. We do not write, review, or take responsibility for your application's code. Fixing bugs, building features, and application-level security decisions (authentication logic, access control, input handling) remain your responsibility unless you've bought a rescue engagement that says otherwise. A hardening report we send you describes what we found; it is not a guarantee that your application is free of defects.
3. Eligibility
- You must be at least 18 years old and have the legal capacity to enter into a binding agreement.
- You must control or be authorised to manage the application and infrastructure you ask us to host.
- You must not be located in a jurisdiction where the Service is restricted, and must not be on any government sanctions or embargo list.
4. Accounts and access
- You must provide accurate and complete information during onboarding.
- You are responsible for the accuracy of any repository access, environment variables, and DNS records you hand over to us.
- You must notify us immediately of any suspected unauthorised access to your account: [email protected].
- We reserve the right to suspend accounts that violate these terms.
5. Acceptable use
You agree NOT to use the Service to:
- Host illegal content, malware, phishing, unlicensed gambling, or crypto mining, or otherwise break someone else's rights or the law.
- Send spam, or launch attacks against third parties.
- Attempt to gain unauthorised access to our infrastructure or to other customers' environments.
- Resell, sublicense, or commercially exploit the Service without our written consent.
- Circumvent plan limits by sharing credentials or misrepresenting the scope of your application.
Breaking this rule means we can suspend your service right away, with no notice period. To report illegal content, email [email protected], our contact point under EU law.
6. Scope of operations and disclaimer
6.1 Nature of the service. We provide infrastructure operations: hosting, deploys, backups, monitoring, and incident response for the server, database, and network layer. We do not guarantee that your application is free of bugs, that a feature will behave as intended, or that a third-party integration you rely on (Stripe, an email provider, an API) will keep working; those depend on your application code, not our infrastructure.
6.2 Backups and restores. We run nightly automated backups and periodically test restores. This substantially reduces, but does not eliminate, the risk of data loss. We are not liable for data loss caused by a fault in your application code, a third-party service you depend on, or an event outside our reasonable control.
6.3 No guarantee against downtime. We do not guarantee your application will never experience downtime. We commit to monitored infrastructure and to responding to infrastructure incidents within your plan's stated response time, published on the pricing page.
6.4 Your responsibility. You remain responsible for your application's code, its security posture, and its compliance with any law or regulation that applies to your business or your own users' data. Where we act as your processor for data stored in the infrastructure we host, our obligations are set out in the Privacy Policy.
7. Plans and payments
- Plans are flat monthly (or annual) fees, published on the pricing page, plus fixed-scope, one-off rescue engagements quoted separately.
- We do not auto-charge usage overage. If your usage approaches a plan limit, we notify you before taking any billing action.
- Card payments are processed by Stripe. We never see or store your full card details.
- Prices may change with at least 30 days' notice before a renewal. A price change never applies to a period you have already paid for.
- Out-of-scope work (see the pricing page's service boundaries) is billed hourly at a rate quoted before we start, or as a fixed-scope rescue if it is bigger than an hour or two.
- You can cancel at any time. On cancellation your plan stays active until the end of the period you have paid for.
8. Refund policy
- First period: if you cancel within 14 days of your first charge, we refund that charge in full.
- After 14 days: you can cancel at any time and keep access through the end of the current billing period. Charges already taken for periods that have started are non-refundable, except where a refund is required by law.
- Service credits: if your application is unavailable for more than 72 consecutive hours due to a fault in our infrastructure, you are entitled to a pro-rated credit for that period.
- Request a refund by emailing [email protected]. Refunds return to your original payment method, normally within 5 to 10 business days.
9. Service availability
We aim for high availability but do not guarantee uninterrupted access. We are not liable for:
- Planned maintenance, announced with reasonable notice where possible
- Interruptions caused by a third-party provider (payment processor, DNS registrar, upstream cloud or network provider)
- Faults or downtime originating in your application code rather than our infrastructure
- Force majeure events beyond our reasonable control
10. Intellectual property and your data
- The Stackbastion platform, brand, and any tooling we build to operate it are our exclusive property.
- Your application code, your database contents, and any data your app stores remain yours; we claim no ownership of them.
- We process your application's data only to provide the Service, as set out in the Privacy Policy, and never sell or share it.
11. Termination
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Use the Service for unlawful activity or to attack third parties
- Fail to pay fees after a 7-day grace period
You may cancel at any time by emailing us. On cancellation, we deliver a full export (database dump, volumes, environment template, DNS notes) within 48 hours, and confirm deletion of your infrastructure in writing once it completes.
12. Disclaimer of warranties and limitation of liability
12.1 Provided “as is”. To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 Excluded losses. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, for loss of data, profits, or business opportunities, or for losses arising from a fault in your application code or a third-party service you depend on.
12.3 Liability cap. Subject to clause 12.4, our total liability to you for any claim arising out of these terms or the Service is limited to the fees you paid us for the affected service in the month immediately before the event giving rise to the claim.
12.4 What we never exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless AKTAI LTD and its officers, employees, and agents from claims arising out of: (a) your breach of these terms; (b) your application's content or behaviour; or (c) your violation of any law or third-party right through your use of the Service.
14. General terms and governing law
Governing law and jurisdiction. These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, except where local mandatory law gives you stronger, non-waivable rights.
Other brands. AKTAI LTD also operates other products under their own separate terms. These terms govern Stackbastion only.
Changes to the Service. We may add, change, suspend, or discontinue any part of the Service at any time. Where a change materially reduces a paid feature you rely on, your remedy is set out in Sections 7 and 8.
Assignment. You may not assign your rights or obligations under these terms without our written consent. We may assign these terms to a successor or affiliate, including in a merger or sale of assets.
Severability. If any provision is held invalid or unenforceable, it will be limited to the minimum extent necessary, and the rest of these terms remain in force.
Entire agreement. These terms, together with the Privacy Policy and any plan details shown at checkout, are the entire agreement between you and us about the Service.
Survival. Sections 6, 10, 12, 13, and 14 continue to apply after your account is closed.
15. Changes to terms
We may update these terms. We will notify account holders of material changes by email with at least 14 days' notice. Continued use after changes take effect constitutes acceptance.
